ABOUT
Congruent Consulting was founded out of - and as a reaction to - our experience and knowledge of the claims, expert witness and litigation services that have developed around construction disputes. And for those construction clients who have found that disputes can over take their projects teams, with significant impacts on projects, staff, and company management.
We advise clients at each stage from the point at which they consider procurement strategies or are reviewing or preparing proposals for projects.
Our aim is to provide advice and support to avoid or mitigate risks and issues. Facilitating appropriate management of and resolution of issues prior to formal dispute process being the most desirable path. Where a dispute is unavoidable, we work with clients to minimise the substance of disputes that escalate beyond inter business negotiations.
We consider this approach to avoiding disputes to be a contributor to the concept of sustainability. We are involved in discussions on the growing consideration of concepts of sustainability within the Built Environment including: the SDGs, Net Zero, biodiversity, whole life carbon assessments, and developing a circular Built Environment economy.

Pre-Contract Negotiations
We carry out and provide detailed reviews of proposed contract conditions. We provide intensive support throughout the negotiation process.
The aim is to provide our clients with clarity on what is being negotiated - to achieve a more balanced risk allocation within the contract, a tender price that corresponds with the risk profile, and to enhance project management processes and procedures.
Strategic Project
Management Assistance
We offer a support resource on projects, ideally following a detailed review of the contract during the pre-contract negotiation stage, to assist at short notice or to advise the project team or company management on steps that can be taken to avoid disputes or potentially to agree mutually beneficial changes to the project, i.e. with another party to the contract.
We can produce project notes for the site team with associated review sessions to identify the key processes within the contract.
Knowledge Presentations
This has proven a cost effective way to avoid disputes. The aim is to educate and prepare your internal management and project teams. This will empower them to make the best decisions for the project and educate them to recognise when they need management or other support. The presentations can be tailored to all levels within the company, setting out best practice from practical site solutions to the latest developments in disputes and sustainability.
Dispute Correspondence
In any project there are points where matters or relationships reach a crossroads. This can provide an opportunity to take stock and produce thorough and clear correspondence for immediate benefit but also for the sake of setting out clearly a narrative that will be relied on should matters deteriorate. An additional benefit is the opportunity to change direction on a project, or to notify management to the actual position on site where it may be at odds with the internally reported position.
Dispute
Management
Whether considering formal dispute resolution processes, or upon receipt of notice of a formal process being commenced against the company, we can assist with identifying and assessing the options the company is facing. We can assist in assessing the best strategy for the company, including appointments and recommendations for those involved e.g. experts, solicitors, and barristers, mediators, adjudicators.
Mediation
We act as mediators and we assist parties in preparing for mediation. The flexibility of the process, the control parties have over all aspects of the process, and its potential to limit or mitigate disputes - even if adjudication or litigation are eventually required - mean it is a process that can have benefits in reducing subsequent costs even if the entire dispute is not avoided. And often it does result in a preferable overall situation, with a higher likelihood of improvement of relationships, compared to adjudication or litigation.
